Welcome to Jade Fairbairn Art. By accessing or purchasing from our website (jadefairbairnart.com.au), you agree to be bound by the following Terms of Service. Please read them carefully before placing an order.

1. General Information

  • This website is owned and operated by Jade Fairbairn Art (“we”, “us”, “our”).

  • These terms apply to all purchases of artworks, prints, commissions, and related products through our website.

  • By using this site, you acknowledge that you are at least 18 years old or have parental/guardian permission to purchase.

2. Products & Availability

  • We offer original artworks, limited edition fine art prints, and private commissions.

  • All product descriptions, images, sizes, and pricing are provided as accurately as possible, but slight variations may occur due to screen display, photography, or materials.

  • Originals are unique, one-off works. Prints are produced in strict limited editions. Once sold out, they will not be re-released.

3. Pricing & Payment

  • All prices are listed in Australian Dollars (AUD) and include GST where applicable.

  • Payment is required in full at the time of order, except for commissions which require a 50% non-refundable deposit to confirm the booking, with the balance due prior to delivery.

  • We reserve the right to update prices at any time.

4. Commissions

  • Commissions are created specifically for the client’s request and are non-refundable, except as required by Australian Consumer Law (ACL).

  • Deposits are non-refundable once work has commenced.

  • Timeframes will be agreed upon prior to commencing but may vary depending on complexity.

5. Refunds & Returns

  • We comply with the Australian Consumer Law (ACL), which guarantees your rights in relation to faulty goods. If your item is faulty, not as described, or not of acceptable quality, you are entitled to a repair, replacement, or refund.

  • We do not provide refunds for change of mind. Please review product details and dimensions carefully before ordering.

  • Originals and commissions cannot be exchanged or refunded unless required by law.

  • To request a return under the ACL, you must notify us within 7 days of receiving your order, providing your order number and photographs of the issue.

6. Shipping & Delivery

  • Orders are packaged securely and shipped via trusted couriers.

  • Delivery times vary depending on your location. Any delivery dates provided are estimates only.

  • We are not liable for delays outside our control, such as courier or customs issues.

7. Intellectual Property

  • All artworks, prints, images, text, and designs on this website are the intellectual property of Jade Fairbairn.

  • You may not reproduce, copy, distribute, or use artworks or images for commercial purposes without prior written consent.

8. Liability

  • Nothing in these terms excludes or limits your rights under the Australian Consumer Law.

  • To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential loss arising from your use of this website or purchase of our products.

9. Governing Law

  • These Terms of Service are governed by the laws of Western Australia, Australia.

  • Any disputes will be subject to the jurisdiction of the courts of Western Australia.
